1. SCOPE / GENERAL

goetterbrauerei.ch is the online shop of Götter Brauerei GmbH, Mühlegasse 18 in 6340 Baar. The offer of goetterbrauerei.ch is aimed at private households in Switzerland and Liechtenstein. Standard delivery: 5-7 working days. Deliveries are made nationwide to all Swiss regions and Liechtenstein. The online product offers are valid only as long as they are visible in the online shop and while stocks last. The images shown in the online shop serve only for illustration and are non-binding. These General Terms and Conditions (hereinafter T&C) apply to all services of goetterbrauerei.ch.

2. REGISTRATION AND ORDERING OF GOODS

2.1 Registration

Registration in the online shop is exclusively reserved for persons with legal capacity. It is free of charge. There is no entitlement to admission to the online shop. The data required for registration must be provided completely and truthfully by the customer. The customer is responsible for updating their own data.

2.2 Order Placement / Conclusion of Contract

Orders are placed exclusively online via the internet order page. Customers’ orders are confirmed by e-mail. A contract between the customer and goetterbrauerei.ch is only concluded with this order confirmation. goetterbrauerei.ch is free to not accept an order - for whatever reason - and to refuse its confirmation. By placing the order, the customer confirms the accuracy of all information provided by them.

2.3 Minimum Order Value

There is no minimum order value per order.

2.4 Right of Withdrawal / Changes and Cancellation of Orders

Subsequent changes to already confirmed orders are not possible. The cancellation of confirmed orders is possible up to 12 hours before delivery.

3. DELIVERY

3.1 Delivery of Goods

Deliveries of goods are made directly to the delivery address and contact person specified by the customer, or are picked up by them at an agreed location. Depending on the assortment and delivery location, delivery is carried out by delivery partners designated by goetterbrauerei.ch. As far as accessible, delivery is made to the apartment door for private individuals within Switzerland and Liechtenstein.

3.2 Delivery Times and Compliance with Delivery Deadlines

goetterbrauerei.ch and its delivery partners make every effort to adhere to the delivery deadlines. However, all delivery times announced by goetterbrauerei.ch serve only as orientation. Failure to meet the delivery deadlines does not give the customer the right to withdraw from the contract or claim damages. In the event that goetterbrauerei.ch or the delivery partners are unable to deliver an order confirmed by goetterbrauerei.ch, goetterbrauerei.ch is not obligated to carry out the delivery otherwise. The customer has no claim to damages as a result.

3.3 Delivery Fees

Delivery costs depend on the selected shipping method and are calculated based on the destination country, shipment weight, and volume of the order. Delivery costs can be calculated in the shopping cart and are shown separately on the order. Any customs duties and value-added tax are not included in the delivery costs. Please note that any customs duties, value-added tax, and potential handling fees are collected directly by the responsible customs office. In the case of a return, the fees incurred by the customs office will not be refunded. If the products sent by us are not accepted or picked up by the customer, or cannot be delivered by Swiss Post, the customer will be charged for all resulting transport costs, including customs clearance costs.

3.4 Delivery in the Customer’s Absence

For quality and security reasons, goetterbrauerei.ch strives to hand over the delivery of goods personally to the customer. If a personal handover is not possible during the agreed delivery time, the goods will be deposited in front of the front door. With the handover of the goods, or the depositing of the goods in front of the door, benefit and risk, especially the risk of theft, damage by third parties, and environmental influences, pass to the customer.

3.5 Packaging

The customer is responsible for the disposal of reusable and returnable glass bottles, boxes, and packaging themselves.

3.6 Complaints and Returns

The inspection of the delivered goods is the customer’s responsibility. Defects must be reported immediately upon receipt of the goods. Otherwise, the goods are deemed to be accepted as flawless by the customer. Hidden defects must be reported to goetterbrauerei.ch immediately after their discovery. Falsely delivered goods that the customer has accepted do not have to be taken back. Products that the customer has ordered by mistake will neither be taken back nor refunded.

3.7 Cancellation of Delivery by goetterbrauerei.ch

If successful delivery is not possible, or only possible under difficult circumstances, for reasons not attributable to goetterbrauerei.ch, such as an incorrect delivery address, absence of the recipient without consent to deposit the goods in front of the door, lack of minimum age of the recipient of the goods, lack of an access permit, bad weather or traffic conditions, etc., goetterbrauerei.ch is entitled to cancel the order. Any claim by the customer for damages or real replacement is entirely excluded in this case.

4. PRICES AND PAYMENT

goetterbrauerei.ch reserves the right to change the assortment and prices at any time. Promotional prices and special offer prices offered on goetterbrauerei.ch apply only to the online shop on goetterbrauerei.ch and only to the extent expressly mentioned.

4.1 Price Conditions

All prices are in Swiss Francs, including applicable value-added tax. The prices displayed on the website at www.goetterbrauerei.ch at the time of the order are decisive.

4.2 Payment Methods

Various payment methods are available for payment, whereby goetterbrauerei.ch is in any case entitled to decide at its own discretion which payment method will be accepted in the respective specific individual case.

5. PRODUCT DECLARATION

5.1 Product Information

The product information published in the online shop is updated regularly and with the greatest care. In exceptional cases, this information may differ from the details actually printed on the packaging. In this case, the information on the packaging is always authoritative. Since recipe changes can be made at any time, it is recommended to regularly consult the list of ingredients on the packaging and to pay attention to the allergy information.

6. YOUTH PROTECTION

At goetterbrauerei.ch, no beer is sold or distributed to young people under 18 years of age. By confirming their legal age, the customer bindingly states their age so that this regulation and the legal requirements can be complied with. Delivery partners of goetterbrauerei.ch reserve the right to carry out an age check before handing over or delivering the goods.

7. WARRANTY OF DATA COMMUNICATION

According to the current state of technology, data communication via the internet cannot be guaranteed to be error-free and/or available at all times. goetterbrauerei.ch is therefore not liable for the constant and uninterrupted availability of the online shop nor for technical and electronic errors during a sales transaction, in particular not for the delayed processing or acceptance of orders.

8. DISCOUNTS, PROMOTIONS & VOUCHERS

8.1 Promotions

The promotions offered at goetterbrauerei.ch may be limited to specific delivery areas and are valid while stocks last. For promotions, the orderable quantity per purchase may be limited.

8.2 Vouchers

At goetterbrauerei.ch, only vouchers on which goetterbrauerei.ch is expressly mentioned as the place of redemption can be accepted. Only one voucher can be redeemed per order; cumulation is not possible.

8.3 Discounts

A cumulation of discounts, or of discounts and promotions, is not possible.

9. INTELLECTUAL PROPERTY AND OTHER RIGHTS

Götter Brauerei GmbH is the owner and operator of the online shop goetterbrauerei.ch. All brands, names, titles, logos, images, designs, texts, and other materials used on it belong to Götter Brauerei GmbH. No rights (rights of use, intellectual property rights, etc.) are acquired by accessing, downloading, or copying pages. The (complete or partial) reproduction, transmission (electronically or by other means), modification, linking, or use of the portal for public or commercial purposes is prohibited without prior written consent.

11. GENERAL CONDITIONS

11.1 Severability Clause

Should parts of these T&C prove to be unenforceable or invalid for any reason, the validity of the remaining provisions shall not be affected thereby.

11.2 Applicable Law & Jurisdiction

Swiss law is exclusively applicable. The place of jurisdiction is CH-6340 Baar or at the customer’s place of residence.

12. CHANGES & ADDITIONS

Götter Brauerei GmbH expressly reserves the right to adapt these T&C to the circumstances at any time and to apply them immediately.
